1Who you are agreeing with

BatchLook is operated by Home and Yacht LLC, a Florida limited liability company, at 4959 Southwest 5th Court, Margate, FL 33068, USA. In these terms "BatchLook", "we" and "us" mean Home and Yacht LLC, and "you" means the person or business using an account. The service runs at batchlook.com.

2What BatchLook does

BatchLook sends your photographs and your instructions to third-party AI image models and returns edited versions for you to review, approve and download. It is a finishing tool for photographs you already have. It is not a delivery platform, it does not host galleries for your clients, and it is not a backup service.

3The beta, and your account

BatchLook is an invite-only beta. An account is personal to you and to the business you run it for. Keep your sign-in details to yourself; anything done with your account is treated as done by you.

You must be 18 or older and able to enter a contract. BatchLook is a tool for professional work, not a service for children, and we do not knowingly open accounts for anyone under 18.

Accounts carry a daily spending limit, so a mistake or a runaway batch cannot spend an unbounded amount in a day. We can disable an account, with or without notice, if it is being used against these terms, if it puts the service or other customers at risk, or if we are required to. Ordinarily we will tell you why and give you a chance to put it right.

4Your photos stay yours

You keep every right you have in the photographs you upload and in the edited versions you download. We claim no ownership of either, apart from the limited use described in section 6.

You confirm that you own the photographs you upload or otherwise have the rights needed to upload them, to have them edited, and to use the result, including any permission needed from a property owner, a client, an agent, a brokerage or a person pictured. If you are editing someone else's photographs, that is between you and them; we rely on your confirmation.

5How you may use the edited photos

You decide what happens to an edited photograph after you download it, and you are responsible for it. That includes following the rules of any multiple listing service, portal, advertising platform, brokerage or regulator that the photograph is published under, and disclosing that an image has been digitally altered or virtually staged wherever those rules, a client or the law require it.

Rules on altered listing images differ between states and between MLSs, and they change. Several require a conspicuous label on or beside a virtually staged image, and some require the unaltered original to be available. We do not advise you on which rules apply to your listing, and nothing on this site is legal advice. BatchLook can burn a "Virtually staged" label into exports and marks staging edits for you; turning that on, and deciding it is enough, is your call.

You must not use BatchLook to misrepresent a property. Edits are for presentation: light, sky, colour, tidiness, and furniture that is visibly staged. Do not use them to hide or disguise a material condition of a property, such as damage, a defect, standing water, a structural problem, or an encroachment, and do not use them to invent a feature that does not exist. Presenting a property better is the point. Presenting it as something it is not is not allowed here, and it may also be unlawful.

6Improving BatchLook's editing

Using BatchLook includes agreeing that, to improve BatchLook's own editing presets and models, we keep a copy of the before-and-after pair of each edit you approve, at working size, about 2K, together with the prompt, the continuity prompt and the edit settings.

These copies carry no file names, no job or client names, no account details and no camera metadata. They are kept after your photos are deleted under the retention policy. They are never shown to other customers, they are never sold or licensed, and they are never used for anything but improving BatchLook's own editing. Edits you do not approve are not kept. You grant us the licence needed to do this, for as long as we keep the pair.

There is no opt-out of this while you use the beta. Because these copies hold nothing that identifies your account, we cannot find yours again to remove them later. If that is not acceptable for a particular job, do not run that job through BatchLook.

7What the AI models can and cannot do

Edits are produced by models operated by Google and OpenAI. We choose the models and write the instructions; we do not control what they return.

Results can be wrong. A model can change something you did not ask it to change, including the structure of a room or a building, it can add or drop detail, it can produce something unusable, and it can decline a request outright. BatchLook keeps a version history and a Blend control so you can compare against your own pixels, and every result waits for you to approve it. You are the last check. Approving, downloading and publishing an edit is your decision, and we are not responsible for what a model produces or for an edit you approved.

Model availability, speed, quality and price are outside our control and can change.

8Payments

BatchLook is prepaid. You buy credits and spend them on edits. There is no subscription and nothing renews on its own.

Card payments are processed by Stripe through Stripe Checkout. You enter your card details on Stripe's own page. BatchLook never sees or stores your card number; we record the amount, the date, the credits added and Stripe's reference for the payment. Stripe's own terms and privacy notice apply to the payment itself, and Stripe emails your receipt.

Prices are in US dollars. 1 credit = 1 cent of purchase price. Taxes, if any apply to your purchase, are your responsibility unless we state otherwise at checkout.

9How credits are spent

• Every run shows its cost on the button before you start it. That number is the most that run will take from your balance. If the models report using less, the difference comes back to you as credits. If they use more than the quote, we absorb it.
• An edit that fails, or that you cancel before it reaches a model, refunds its credits to your balance automatically. You do not have to ask.
• Credits do not expire.
• New accounts are given a welcome amount of credits at invitation so you can try the service without paying. Gift credits are for trying BatchLook, are not purchased, and are not refundable in money.
• Prices per photo can change. The price shown on the button when you click is the price you pay for that run.
• We can add credits to an account, or hand credits back, to put a problem right. Every such adjustment is recorded with a reason in an audit log.

10Refunds

Two different things are called a refund, so to be exact:

Credits inside the service. A failed or cancelled edit refunds its credits automatically, and a run that cost less than its quote returns the difference. This is how the product works and it needs no request.

Money back on a purchase. Credits are not refundable for money as a matter of course, and unused credits simply stay in your account. If you bought credits by mistake, or something went wrong that we should make right, write to us and ask. We consider these case by case and we do not promise a refund. Card refunds are handled by hand at the moment, so allow a few business days for one to be agreed and to appear on your statement. Where consumer law gives you a right to a refund that these terms do not, the law wins.

11Acceptable use

Do not upload content you have no right to use. Do not upload unlawful content, or content that sexualises or endangers anyone. Do not use BatchLook to deceive buyers, tenants or anyone else about a property, as described in section 5. Do not attempt to break the service, to reach another customer's photos or account, to work around spending limits or account limits, or to resell access to your account. Do not use the service to build a competing model or dataset from its output.

We can refuse or stop a particular edit, and we can suspend or close an account, for breaking this section.

12Copyright complaints

If you believe material processed or published through BatchLook infringes your copyright, write to us at hello@homeandyachtmarketing.com, or to Home and Yacht LLC at the address in section 1, with: your contact details; enough detail to identify the work you say is infringed; enough detail to identify the material you want removed; a statement that you believe in good faith that the use is not authorised; a statement that the information in your notice is accurate; and your signature, electronic or physical.

We look into complete notices, remove or disable access to material where that is the right answer, and close the accounts of repeat infringers. If your material was removed and you think that was wrong, write to the same address and say so.

13Availability, and the beta changing

BatchLook is provided as is and as available. To the fullest extent the law allows, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted service, a particular level of quality from a model, or that a result will suit a given listing.

Model providers have outages and rate limits. Edits are retried automatically and refunded in credits if they still fail.

This is a beta. Features can change, be removed, or be priced differently, and the beta itself can end. If we make a change that materially reduces what you have already paid for, write to us and we will refund unused credits.

Keep your own archive of your camera files. BatchLook deletes photos on the schedule in the retention policy and is not your backup.

14Limits on what we owe you

To the fullest extent the law allows, neither we nor anyone working with us is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales, lost listings, lost data, or damaged client relationships, even if we were told they were possible.

To the fullest extent the law allows, our total liability for all claims relating to BatchLook is limited to the amount you paid us in the twelve months before the event the claim is about. If you have paid us nothing in that period, our total liability is limited to one hundred US dollars.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.

15Claims caused by your use

If someone brings a claim against us because of the photographs you uploaded, because you did not have the rights you said you had, or because of how you used an edited photograph, you will cover our reasonable costs and any damages arising from it. We will tell you promptly about any such claim and let you take part in handling it.

16Ending the agreement

You can stop using BatchLook at any time and ask us to close your account. We can close or suspend an account as described in section 3 or section 11, and we can end the beta as described in section 13.

When an account closes: download anything you still want first. Photos are deleted on the retention schedule or sooner, unused purchased credits can be refunded at our discretion under section 10, gift credits are not refundable, and the sections of these terms that are meant to outlast the account, including sections 6, 14, 15 and 18, continue to apply.

17Changes to these terms

We can change these terms. The date at the top says when they last changed. If a change materially affects you, we will tell you by email to your account address or by a notice in the app before it takes effect, and continuing to use BatchLook after that means you accept the new terms. If you do not accept them, stop using the service and ask us to close your account.

18Which law applies, and where disputes go

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts located in Broward County, Florida, and both of us agree to those courts having jurisdiction over us. There is no arbitration clause here and neither of us is required to arbitrate.

19The rest

These terms, together with the privacy notice and the retention policy, are the whole agreement between us about BatchLook. If a court finds part of these terms unenforceable, the rest still applies. Not enforcing something once does not give it up. You may not transfer this agreement without our consent; we may transfer it to a successor of the business. Nothing here makes either of us the other's partner, employee or agent.
